Diversion
If you successfully completed all the diversion program requirements, your record should already be changed to show a dismissal. If you did not complete your requirements or were not actually given diversion, then the conviction will be on your record.
However, if your drug diversion case was dismissed pursuant to Penal Code section 1000.3 you are eligible for further dismissal under Penal Code section 1203.43.
Marijuana possession offenses
If you were convicted of possession of marijuana for personal use, then you do not necessarily need to get a dismissal for the offense. Under California Health and Safety Code sections 11361.5 and 11361.7, all convictions for possession of marijuana for personal use, after January 1, 1976, are erased from your record after 2 years.
*BE CAREFUL! The conviction cannot be for cultivation, sales, or transportation. If it is, it will be on your record.
